 ORAL ORDER: Having reviewed Defendants' motions to strike Plaintiff's final infringement contentions for U.S. Patent No. 6,359,654 (the "'654 Patent") (C.A. No. 15-379 D.I. 222; C.A. No. 15-788 D.I. 162) and associated exhibits and declarations, IT IS HEREBY ORDERED that Defendants' motions are DENIED. Infringement contentions must serve the purpose of providing notice to Defendants of Plaintiff's infringement theories beyond that which is provided by the mere language of the patent. Yet Plaintiff need not in its contentions actually prove its infringement case. Plaintiff provided detailed diagrams of each accused product's allegedly infringing functionality with identification of source code signals and commands that show how (in Plaintiff's view) each limitation of each claim element for all asserted claims is met by each accused product. These contentions are sufficient to provide Defendants notice of Plaintiff's infringement theories. Given that some source code excerpts are difficult to read, IT IS FURTHER ORDERED that Plaintiff provide all Defendants with encrypted electronic copies of its infringement contentions for the '654 Patent no later than January 30, 2018. Contrary to Defendants' suggestion, this is not "new" evidence. Finally, IT IS FURTHER ORDERED that the teleconference scheduled for January 29, 2018 is CANCELLED. ORDERED by Judge Leonard P.
