Pursuant to Fed. R. Civ. P. 41(a)(1)(A)(ii) Defendant Stryker Corporation (“Stryker”) and the Plaintiff, Surgical Irrigation Technologies, Inc. (“SIT”), by and through their undersigned counsel, hereby stipulate and agree to the dismissal of Plaintiff’s Complaint in this matter with prejudice. The Parties further stipulate and agree to the dismissal of Defendant’s counter-claims in this matter without prejudice. Each party shall be responsible for its own fees and costs.
