Pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(i), Plaintiff Mobile Charging

Solutions, Inc. (“MCS” or “Plaintiff”) hereby files this Notice of Voluntary Dismissal,

dismissing its claims against Defendant Duracell International, Inc. (“Duracell” or “Defendant”)

without prejudice. Duracell has not yet answered the Complaint, nor filed a motion for summary

judgment. Each party will bear its own costs.
