"The parties are involved in two other cases currently pending in the Eastern
District of Texas: Wi-LAN v. Alcatel-Lucent et al., Case No. 10-cv-521 (Davis,
J.) and Wi-LAN v. Apple et al., Case Nos. 11-cv-068, 12-cv-600 (Gilstrap, J.).

The parties have discussed the potential for settlement as part of these cases
and expect to continue settlement discussions as these cases progress. The
discussions to date have not included settlement in the context of the present
case but the parties agree to pursue settlement in good faith."
