Second Santa, I would like to nudge your memory of the intention of the Stikeman Elliott pamphlet. As you and I both know, one has to fully understand the complete pamphlet from a legal point of view before applying the principles of the pamphlet to any one case. It is impossible to apply only one principle of the pamphlet to a case, while ignoring another principle of the pamphlet that would undermine the case...
