Message: BCSC in violation of the FOI Act?

Apparently by this article the BCSC is in violation of the Freedom Of Information Act.

(BCSC hasn’t taken any legal extension, which means it is simply in violation of the Act. I talked to Brian Feeney, BCSC’s FOI coordinator, this week and he said the data is all ready but he’s waiting on his bosses to sign off on it.)

The BCSC is a public agency and if it cannot comply with laws itself, how can it protect investors lawfully? We sent letters to the BC justice minister about our case, among a couple other connected politicians, that are above the BCSC and are responsible for keeping the BCSC accountable as well.

(BC Hydro and BCSC are arguably two of the most sophisticated public agencies in the province — one has to keep the lights on for the entire province, the other to make sure our financial markets operate fairly.)

In our case, it appears we are not getting treated fairly by the BCSC by making a blatant 91% vote being decided by a judge if its legal or not. Common sense would tell one that if another vote were to take place, that it would still be a landslide and perhaps more. The Securities are well aware of the many actions that management have taken that are against shareholders best interests, and if they feel they cannot act, it should be their responsibilty to ensure that the Exchange or other Authority does, in protection of shareholders.

The Ombudsman/ Ombudsperson of British Columbia may be able to lay charges, free of charge against the BCSC or the Justice Ministers Department in our case if reasonable cause is found that the BCSC/ Justice System has treated us unfairly in not administering to our grave concerns. We voted, went through the appropriate legal process, and legal action should be taken against management for misconduct, and the entire BOD should be removed if the entire board did not object to the CEO,s actions of the meeting. Not only this, but the BC Justice system should also have taken action instead of placing this undue pressure and monetary burden upon shareholders to seek a ruling by a judge to see if this is democratic, this is where it is totally unfair and perhaps the Ombudsperson can do their job?

Welcome! If you think a provincial government ministry or public agency has treated you unfairly, we may be able to help. The Office of the Ombudsperson receives enquiries and complaints about the practices and services of public agencies within its jurisdiction. Our role is to impartially investigate these complaints to determine whether public agencies have acted fairly and reasonably, and whether their actions and decisions were consistent with relevant legislation, policies and procedures. Our services are provided free of charge.

The B.C. Ombudsperson is an officer of the provincial legislature; independent of government and political parties; responsible for making sure that the administrative practices and services of public agencies are fair, reasonable, appropriate and equitable. If you have questions or would like to make a complaint, please contact us.
