If they meet the terms of the contract, its theirs. I guess when you look at its value, they wouldn,t want to breach the contract. Maybe thats why all the recent fund raising by them, to make the final payment/s. The NSR can be bought out too for the specified price in the option agreement.

I am not sure on the status of the agreement, if they mean 2008 or the formal agreement?
