Message: Is the SRP in effect now?

The news release says that there is nothing in the works but Khareema makes a good point in basically saying, why then the rush today?

From the news release; " Probe is currently unaware of any party contemplating or preparing a proposal to acquire control of the Company."

I have a question that perhaps someone (K, maybe) could answer. The news release says that there is now a share holder rights plan.

"The Directors of Probe Mines Limited (TSX VENTURE:PRB) ("Probe") are pleased to announce that its board of directors (the "Board") has approved the adoption of a shareholder right plan (the "Plan") dated August 16, 2010." And, "At the close of business on August 16, 2010 existing shareholders of the Company were granted "Rights" to acquire additional common shares."

Later in the release it states that this is subject to ratification by the shareholders at the annual meeting on Oct. 7. "The Board's approval of the Plan is subject to the TSX Venture Exchange's acceptance and the ratification by the shareholders of the Company at the annual meeting of shareholders of the Company scheduled for October 7, 2010."

The stated duration that it will be in effect; " Unless otherwise terminated in accordance with its terms, the Plan will terminate at the close of the third annual meeting of Probe shareholders, following the meeting at which the Plan is ratified by shareholders, unless the Plan is reconfirmed and extended at such meeting."

My question is; Is the SRP currently in effect or will it not be in effect until Oct. 7 when it would no doubt be ratified by the shareholders? Perhaps it means it is in effect now and to go beyond Oct. 7 it must be ratified? At first it sounds like a done deal as of today but then the ratification statement left me wondering. It's just not clear to me. Are we vulnerable at this point in time?
