Assuming A or B is not the point.  Assuming that it is a plausible possibility and investigating / testing that possibility IS the point.

"Forgetting" to disclose lawsuits is a huge f%#&up, and if you are f%#&ing that up, what else are you f%#&ing up?   A logical question in and of itself.
