I finally read the details of the civil case. It was a painful read. Here are the lowlights:
FG told Platinum that they will be processing 440,000 tons/month at a grade of .015625 with a 64% recovery. Thus producing 4400 ounces of gold per month.
Does everyone notice the math works a little to well here? .015625 *.64 = .01 exactly.
Actual as reported by Platinum (who they say Stephen Tibbals reported to them) was:
150,000 tons/month of ore processed of a grade of .008 or less and a recover less than half of the 64%.
Tibbals said in ideal conditions 40% yield and Kappes Cassidy report stated yield of 13% - 18%
FG said they were planning to move o the pits, instead, by Q1 2009.
