As I have said, repeatedly, I was told way back in Jan`00 by RP that when Flash reaches a point of proliferation, they would consider pursuing infringers. What WAS the #1 MP3 player? IPod. As of a couple of weeks ago, IPod is dead, being replaced by Flash only devices (e.g., Nano). So we`re at or very near a point of ``proliferation``.
The only influence I SUSPECT on EDIG by the PTSC situation is ready access to a patent attorney firm that may be willing to deal, and that has funding available to support such an endeavor. TPL is THE likely suspect in all this, and they have, as of a couple of weeks ago (HP licensing), proven successful results (ignoring any prior success stories they may have).
IMO the convergence of these events has prompted possible action (at least they`re thinking about it).
So you may see this as suspect, and maybe it is (next thing for investors to look forward to - there always seems to be one, or more). But I see it as events and opportunities coming together to make the effort feasible.
IF Apple hadn`t made its move and essentially announced that Flash is King, and if TPL weren`t at our doorstep with proven results and cash on hand (cuz EDIG certainly wasn`t in any position to fund any patent infringement litigation), we probably wouldn`t have seen this in the PR (maybe something else to look to, but not this).
We need to relook at the language of those patents, try to get a grip on their meaning, evaluate as possible their viability, and maybe come to some conclusions.
I`m fairly certain that any handheld flash-based device capable of voice recordings is probably an infringer - but that`s just one (that I feel pretty comfortable about). Don`t know how many of those are out there right now. But (again, need to review the language, cuz I`m going by recollection - scary stuff LOL), if one were to interprit ``recording`` as installing any data (e.g., music and video), every new Apple device is an infringer (along with every other flash-based device out there, including digital cameras).

Somebody has got to have a copy of the language of those patents. Please post `em so maybe we can figure out if there is anything to any of this. If I don`t see `em soon, I`ll go into patent search mode. I`m lazy, so don`t make me do that!
