We`ll have to disagree on this one. EDIG did not do everything right. They did do many things right -- like not give away the farm to Wencor while keeping them as a customer. As far as we know, Wencor does not have a portable replacement for the current digEplayer. For now, the relationship is about what Wencor needs and EDIG can provide to fill that need.
When producing OEM projects, a document exists stating exactly what is ``work for hire`` and what is not. Sometimes it is as simple as the originating purchase order to get work started. EDIG and APS did not produce such a document. If they had, Wencor would have no reason to dispute the ownership of the IP. RP stated that there was an issue with IP and Wencor. Wencor`s management team are not dummies, either. We don`t know what Boyer told Brent Wood. Boyer was certainly not an experienced OEM buyer. My guess is that has worked in EDIG`s favor since sunpoop is right about EDIG`s PRs on owning the tech inside, but not the cosmetics. However, putting out a PR does not mean it holds up in court. Trust me on this one. Been there. Trademark laws are tricky and it takes lots-o-cash to fight a problem. EDIG knew that part and was / is not in a position to file a lawsuit. That`s where EDIG did it right...new design, their tech, no question about it.
Wencor can choose to buy the new eVU format or not. I like the ``menu`` approach. That`s the way I do business. It is easier and the OEM buyer knows they are buying our stuff -- no pissing contests needed. I trust EDIG will or already has a customer, wishfully multiples. However, we don`t really know anything other than testing should be in progress now or very soon.
Of course, we should all hope Wencor buys eVU in some configuration. In the real world, nobody cares who is liked or who is a control freak scumbag. The scorecard is simple, it is called a P & L statement.
