On December 29, 2016, the Court issued an order requiring e.Digital to file its motion for default judgment no later than February 10, 2017. (ECF No. 18.) On January 4, 2017, counsel for e.Digital received a phone call from Devin Chawda, CEO for Y-Cam. (See Declaration of Gabriel Hedrick filed herewith at ¶ 3.) Since that time, counsel for e.Digital has had several discussions with Mr. Chawda regarding a potential resolution of this litigation. (Id. at ¶¶ 4-5.) However, e.Digital understands that Mr. Chawda resides in the United Kingdom and, accordingly, the time difference as well as personal circumstances of Mr. Chawda, have hindered any attempts at a speedy resolution. (Id.) Nevetheless, the Parties are continuing their discussions. (Id.) e.Digital is informed and believes that Y-Cam has not yet retained outside counsel to represent them in this case and it is unclear yet to e.Digital whether Y-Cam will do so or whether it will otherwise seek relief from default. (Id. at ¶ 6.) However, because e.Digital and Y-Cam are engaged in ongoing discussions aimed at resolving the case without the need for further litigation and in an effort to avoid the expense of preparing a motion for default judgment that may be rendered moot either by settlement or by motion for relief from default by Y-Cam, e.Digital respectfully requests an extension of sixty (60) days to file a motion for default judgment against Y-Cam
