The USPTO should now publish disclaimers for applicants. "Your patent is useless until it's gone through an IPR procedure.....and by the way, once you have a patent published, you can not apply for that procedure.
For e.Digital type issues that re-invent prior status quo metrologies.....AIA is going to kill US innovation to a great degree....there are only so may definitive paths to follow technically....like four.....IMVHO now reducing over time down to one.
Of that four innovation has been, to a great degree, to get the four to work together with countless methods (translation) to interface, all patented as significant.
That's what the industry was, however, that's not what it's going to be in the future. The future is in getting rid of the cobbling together to interface antiquation. Though many are still saying it's still there....e.g for security issues.
It's like status quo is saying, you can not reinvent over our bones....and we are going to hold AIA over your patented innovations.
Like data structures.....e.Digital or anyone else for that matter... can not re-invent paging principles, meta data principles, RAM techniques...etc that when combined surpass countless out dated translation platforms,,,,e.g FTL ....or antiquated data structures e.g FAT or UNIX.
Though it goes un-noticed or understood...long live claim one of the 108 and 445.
