I agree Re:the judge got it wrong in Colorado and it rendered the Flash R portfolio worthless, relatively speaking.
However, during that time the Flash Patents were represented and litigated by a very different team of attorney's. Those teams decided to appeal the Colorado opinion with a new team leader representing the appeal. We all should aggree the favorable appeal assisted in getting the company down the road with new Patent Portfolios Nunchi, Microsignet, and Project Pluto.
Learning from past missteps the New Judge presiding over the Marksman in the Northern District Court was provided (Tutorial) regarding the intentors ideas oposed to the Colorado Judge. IMHO being provided a tutorial does provide assistance in this Marksman Hearing to the Judge in getting it right. Although, investing offers no gaurantees. I choose too believe that a best effort was given in obtaining a favorable opinion of the inventor that were written into the patents. Whatever the venue Federal District or IPR IMHO we will rise to the occaision.
