and hereby does move for an order to dismiss Plaintiff e.Digital Corporation’s (“e.Digital”) Complaint against Microsemi in the above captioned case.
This Notice and Motion and accompanying Memorandum of Points and Authorities are made pursuant to Federal Rule of Civil Procedure 12(b)(6) on the grounds that e.Digital’s Complaint fails to allege facts that state a plausible claim for relief. Accordingly, e.Digital’s Complaint should be dismissed for failing to name the proper defendant and failing to properly plead claims for direct infringement, induced infringement, and contributory infringement.
