For one thing the boards ruling did not consider any harm to e.Digital what so ever....however, my consideration, specifically weighed harm in the petitioners favor. (read into that as you wish)
With that , there are statutory issues involved that dictate proper performance not adhered to. Regulatory issues , as well as, courtesy issues do not matter when considering statutory considerations.
Anyway, FWIW, that is what the IPR re-hearing request by Percell is all about.
