As you appreciate the USPTO & court action it only decided the settlement for patent 737, #774 and #170. The reason for Without prejudice rest on future litigation forpatent # 108 . It dosent matter which side agree for such a phrase , either side will be prepared to be ready for possible legal ramification.JMHO
