After scanning over the defendants argument... I understand more of what Sunpoop was saying about disavowal and disavow... the defendant was trying their best to tie patent 108 with patent 445. After reading it, you would think they were doing a claims construction for patent 445... it sounds as if the JUDGE wasn't having any part of it. We'll see soon enough.
