Yes they asked and it has not been acted upon as of yet . Maybe the USPTO will do IPR or maybe they won't but if you read the document (and I must confess I skimmed over quite a bit) it seems to tip Microns hand as to what they will argue in court be it the CC or a trial if that should ever happen. Everything Micon is doing is to gain a foothold from which they can bargain down an eventual payout. JMO.
