Re Micron docket... for Micron Consumer Products Group, Inc.
"Further, Defendants served amended invalidity contentions, as they were
entitled to as a matter of right, on December 29, 2014. Id. at 10:5-7. Defendants
then filed their petition a mere two days later, on December 31, 2014. Thus,
viewing the entirety of the facts, Defendants’ timing to file the IPR petition was
more than reasonable."
No filing, that I can see of that nature, for December 29, 2014...I see Answer to AmendedComplaint on 6-12-14
Must have been a non offical filing Amending their answer to e.Digitals amended complaint?
==================================
Considering the above: e.Digital filed its amended complaint 3-21-14; defendant ansered the amended complaint 6-12-14 or 52 days later; defendant then files amended invalidity contentions, as they were entitled to as a matter of right, on December 29, 2014...or 5.5 months later ...to coinside with a 12-31-14 USPTO/IPR petition...and a motion for stay 1-7-15.
5.5 months to amend invalidity contentions? I do not see the formality filed?
"as a matter of right"...,Come on lets get this over with..e.Digital has rights as well, and Micron is not timely.
