I feel the opposite is a consideration, the USPTO/IPR can/will lean on the courts Markman hearing...

In any event, IMO, Micron is too late.... and that was a point of contention by Handal.

A claims construction hearing is upon them NOW. The proximity of that date indicates how far along the case is.
