108 would have to be retied back to 774.

The court was very clear as to why 774 and 108 are not tied together as separate and distinct issues. Will the defendants challenge this for a different conclusion? The defendants consider the courts order an opinion...which to me, means not based on any principle of law.

Thing is, I can review the continuity of 774 and 108 and they are not physically connected by the USPTO and were prosecuted by the USPTO as separate issues.

IMO, the case conclusions are shortly coming, they must act by 2-12-15(?)
