10/21/201442Minute ORDER: On October 17, 2014, Defendant Intel Corporation filed a motion to stay the case pending inter partes review of the patent-in-suit. (Doc. No. 40 .) The motion is set for hearing on November 17, 2014. Plaintiff's opposition is due November 3, 2014. Civ. L.R. 7.1. The Court declines to stay the case while the motion is pending. Intel subsequently settled, it did not bother to motion for a new hearing date when it was vacated in doc 39...due to other activities by Intel.
Does Micron have the same circumstances? Will the court automatically issue a hearing date without staying? Will Micron motion for a hearing to review/stay as considered in the Intel case? Or will Micron simply do as Intel finally did?
I would say the stakes are higher for Micron at this point.
Anyway, as it looks to me there are possibilities.
