DEFENDANTS’ NOTICE OF MOTION & MOTION TO STAY
PLEASE TAKE NOTICE THAT on February 9, 2015, at 10:30 a.m., or as soon as the matter may be heard, before the Honorable Marilyn L. Huff at the United States District Court for the Southern District of California, Courtroom 15A, 333 West Broadway, San Diego, California, Defendants Micron Consumer Products Group, Inc. and Micron Technology, Inc. (the “Defendants”) will, and hereby do, move to stay these consolidated cases while the United States Patent & Trademark Office considers Defendants’ petition for inter partes review filed on December 31, 2014 (No. IPR2015-00519), and reviews the asserted claim for validity with respect to the patent-in-suit, U.S. Patent No. 5,839,108.
This motion is based upon this Notice of Motion; the supporting Memorandum of Points and Authorities; the supporting declaration of Matthew A. Ferry and exhibits attached thereto; all pleadings and papers filed in this action and other similar cases; and such other arguments and evidence as may properly come before this Court.
