All water under the bridge by the time the judge dismissed the case.

I would say the parties came to term, partly, because of this..

RE: e.Digital comment...regarding sanction motion

"The company has requested that Toshiba’s motion be denied, but if it is granted, that the court allow it to amend its complaint again."

In the interim...the back and forth chatter was over, e.Digital and Toshiba came to terms...

There was nothing more than having an ORDER to have the case closed.... and there was no need to inject any comments of any kind into the ORDR in to closing the case.
