No, the case was dismissed, while the defendant had a motion of sanction considered for the court to rule on.

The judge closed the case with prejudice...and he did not rule on the defendants motion of sanction that was still before the court. He gave comments of consideration regarding the motion...however he did not rule on it. The judge put the defendants motion in limbo...along with his comments...and e.Digital is giving notice of that fact.
