PLEASE TAKE NOTICE THAT on October 6, 2014 before the Honorable Marilyn L. Huff at the United States District Court for the Southern District of California, Courtroom 15A, 333 West Broadway, San Diego, California, Defendant Toshiba America Information Systems, Inc. ("TAIS"), will, and hereby does, move pursuant to Federal Rule of Civil Procedure 11 to dismiss Plaintiff e.Digital Corporation’s First Amended Complaint for Patent Infringement with prejudice, grant sanctions and payment of Toshiba’s attorney’s fees and costs incurred to date, and any other sanctions the Court deems proper.

This motion is based upon this Notice of Motion; the supporting Memorandum of Points and Authorities; all pleadings and papers filed in this action; and such other arguments and evidence as may properly come before this Court.
