[PROPOSED]ORDER
Appellant e.Digital Corporation moves without opposition to voluntarily
dismiss the appeal entitled e.Digital Corporation v. ZTE Corporation, et al., Fed.
Cir. Case Number 14-1239 (“ZTE Appeal”) pursuant to Federal Rule of Appellate
Procedure 42(b).
Appellant is not seeking to dismiss any of the following appeals which have
been consolidated with the ZTE Appeal:
• e.Digital Corporation v. Woodman Labs, Inc. (District Court Case No.
3:12-cv-2699-DMS-WVG); date of docketing 1/15/2014; Fed. Cir.
Case Number 14-1243; and/or, • e.Digital Corporation v. Pantech Wireless, Inc. (District Court Case
No. 3:13-cv-23-DMS-WVG); date of docketing 1/15/2014; Fed. Cir.
Case Number 14-1242.
Upon consideration thereof, IT IS ORDERED THAT:
(1) The motion is granted, and the appeal e.Digital Corporation v.
ZTE Corporation, et al., Fed. Cir. Case Number 14-1239, is
dismissed.
(2) Each side in the ZTE Appeal shall bear its own costs.
(3) The revised official caption for the pending, consolidated e.Digital
appeals that have not been dismissed by virtue of this order is
reflected above.
