IMHO--the appeal is in process and Handal is saying that 108 should be removed from the estoppel ruling and the ruling should only apply to 774 and be decided on its own merits. The most recent 41 that have to do with claim 1 of 108 should be able to proceed without being encumbered by the estoppel ruling.
