"Defendant and Counterclaimant Motorola Mobility LLC's counterclaims against e.Digital Corporation (Docket #23) are hereby dismissed without prejudice; "
Motorola is ready for the future, if its feasible for e.Digital to venture beyond the stipulations of the SPJ.
IMO, e.Digital gave away prior and current devices....for 774 and 108(if part of their infringement claims)...
Motorola did what was best for Motorola...and e.Digital did what was best for e.Digital.
Apple is trying to reshape the future of e.Digital...and must find the issue of trying to do so, ... worth the effort to keep 774 33/34 locked up if it can.
Thing is, 774, not as a money maker...turns the other patents into money makers.
That is why Apple continues on as they are....They know the value of 774 having gone through a judicial process of extreme ridicule and a re-Exam....For that, the other patents will not go through those processes, because, the outcome, if they do, will be on par with a positive proof 774, even if it's not a money maker.
