The plot thickens. Now, our lawyer is accused of misrepresenting her future plans!
This is crazy for the following reasons.
1. Millions of dollars are at stake. This jerk will need a recording of the conversation and even if he were smart enough to record it, it still won't stand. Big money transactions are done in writing.
2. This is a joint motion for stipulation--he owns it. How can he come back later and say he was duped? I don't think he can argue for amendment.
3. He's too late. Civil precedure has rules and time limits; he just plain screwed up and Woodman Labs aka GoPro should sue him and his law firm.
4. Everybody knew EDIG would sooner or later would appeal the CO decision (in this case sooner was much better than later). We have several grounds to argue that CE based on Judge Kreiger's finding should not be the ruling.
