What Apple is trying to do is appeal the CE on its own....through the 54(b) process(?). To make that happen, Apple has to get the judge to amend his ruling doc 51 on their stipulated partial judgment.. Once that happens, then have the court consider a dis-positive ruling on 774.....Based on that ruled action would then open up the process to appeal the CE....form Apples prospective with 774 only.
