"Under the terms of the confidential agreement, Samsung obtained a license and release on e.Digital’s foreign and domestic patent rights, including the Company’s Flash-R™ patent portfolio, and e.Digital obtained a license and release on certain Samsung patents. e.Digital also received a one-time licensing fee."

ORDER DISMISSING ALL CLAIMS OF UNITED STATES PATENT NOS. 5,787,445 AND 5,839,108 BETWEEN e.DIGITAL CORPORATION AND SAMSUNG ELECTRONICS AMERICA, INC.

Having considered the Stipulation Between e.Digital and Samsung Regarding Dismissal of All Claims of United States Patent Nos. 5,787,445 and 5,839,108 and good cause appearing therefor, IT IS HEREBY ORDERED, as follows:

1. All claims by e.Digital Corporation of infringement relating to U.S. Patent Nos. 5,787,445 (“the ‘445 patent”) and 5,839,108 (“the ‘108 patent”) that have been or could have been brought in this lawsuit against Samsung Electronics America, Inc., or related Samsung entities that could have been named in this lawsuit, are hereby dismissed with prejudice.

2. All declaratory judgment counterclaims by Samsung Electronics America, Inc. of non-infringement relating to the ‘445 and ‘108 patents that have been brought in this lawsuit are hereby dismissed with prejudice.

3. All declaratory judgment counterclaims by Samsung Electronics America, Inc. of invalidity relating to the ‘445 and ‘108 patents are hereby dismissed without prejudice. (Note, does not relate to this law suite)

4. The parties represent that as of the filing date of this Stipulation, and in view of the paragraphs above, there is no current case or controversy between them within the meaning of the Declaratory Judgment Act with respect to the ‘445 and ‘108 patents.

5. Each party is to bear its own costs and attorneys’ fees with respect to the ‘445 and ‘108 patents.

Future issues not relating to this law suit are still open...on behalf of Samsung

3. All declaratory judgment counterclaims by Samsung Electronics America, Inc. of invalidity relating to the ‘445 and ‘108 patents are hereby dismissed without prejudice.

With that, e.Digital can bring a case against Samsung over 445 and 108 in a new case....and Samsung can still have the issues considered it previously did.

Regarding, 445 and 108, they are not part of the settlement statement...."Samsung obtained a license and release on e.Digital’s foreign and domestic patent rights, including the Company’s Flash-R™ patent portfolio,"

all e.Digital’s foreign and domestic patent rights regarding Samsung...are not in play or considered.

I consider Casio A friendly having " Under the terms of the confidential agreement, Casio obtained a license and release on all e.Digital foreign and domestic patent rights, including the Company's Flash-R™ patent portfolio, "

I consider Olympus A friendly having " Under the terms of the confidential agreement, Olympus obtained a license and release on all e.Digital foreign and domestic patent rights, including the Company's Flash-R™ patent portfolio, "

They are the only two having something going on with e.Digital that allowed the agreements as they are... Now that Appl is coming out with watch issues, might Casio/e.Digital have a concern?

The legal team representing Casio....went on to defend for HTC, which settled with e.Digital for FlashR " Under the terms of the confidential agreement, HTC obtained a license and release on the Company's Flash-R™ patent portfolio

Casio and Olympus have something special going on.
