"Philips Electronics North America Corporation was personally served with the Complaint

on November 29, 2012. Pursuant to Rule 12 of the Federal Rules of Civil Procedure, Philips

Electronics North America Corporation’s response to the Complaint is currently due on or before

December 20, 2012.

The parties seek this extension for, among other reasons, the response to the Complaint is

due during the holiday season when counsel for both sides and/or representatives of the parties in

this matter have set vacations.

Moreover, the Complaint alleges infringement of four different patents, which Plaintiff

contends cover one hundred or more accused products. Accordingly, the parties agree that

additional time to respond to the Complaint is warranted.

Further, the parties need time to determine whether this matter can be settled. The parties

to this Motion also wish to have an opportunity to discuss possible resolution of this matter and

need time to do so. "
