"The only winners are the thieves that will use what does not belong to them and do so because of the courts."
If you read the issues of the case I just emphasized for Dischino...
Teleflex, Inc. sued KSR International
How obvious is controlling a device with a cable? Seems quite obvious to be ...nothing non- obvious about that to be considered a claim term with broad implications.
The district court sided with the defendant.....
On appeal...based on "teaching-suggestion-motivation" ...then turns that decision around and sides with the plaintiff....
Defendant gets its case into the Supreme Court and they turn it around in defendants favor....based on an opinion that...."Court of Appeals analyzed the issue in a narrow, rigid manner inconsistent with ยง103 and our precedents," ......in other words, we do not identify with the way or approach that "teaching-suggestion-motivation" .....teach......lol
What a world of opinions we live in....lol.
I guess the case to watch would be the guy that invented the new wrench that Sears is now selling under the "Craftsman" name brand.
The patent owner is now in court with that problem...of how Sears is ripping him off.
Sears is now manufacturing the Craftsman brand in China....Not only is he being ripped off for patent infringement, so are consumers. Craftsman tool was Sears best... as compared to Sears tool brand.....I'm sure they have not adjusted pricing between the two.
