I tried to explain this previously from my phone conversation but did not say I had talked to him. I conveyed the info repeatedly but it was not a definitive email quote. Since the appeal topic just kept coming up, decided I'd try to get it in writing.

I also visited Fred after the 9/25 PR and we discussed it again, and I had another poster here with me.

One would think the USPTO would have entered "appeal canceled" after mailing out the NIRC, or EDIG would have canceled it? It left the question dangling, but now it's behind us for good...lol.
