Anton N. Handal: Founder of the firm, was admitted to the California Bar in 1984 and the Florida State Bar in 1987. Mr. Handal received his BA in Economics from UCLA in 1980 and his JD from Southwestern University School of Law in 1982. He is a member in good standing with the Bar of the United States Supreme Court, the Bar of the United States Court of Appeals for the Federal Circuit, the State Bar of California and the United States Ninth Circuit Court of Appeals, the United States District Courts for the Southern, Central and Northern Districts of California, as well as the Central District of Florida. His pro bono work includes serving as counsel to the San Diego Fire Youth Soccer Team, as a member of the Villa View Hospital board of directors, and as a member of the Board of Trustees of the San Diego Railroad Museum.

LITIGATION: Mr. Handal is an experienced trial lawyer with an understanding of trial techniques, discovery, motion work, and case presentation. He has litigated cases in Federal Courts, State Courts and at Arbitrations. Notably, Mr. Handal and Mr. Hedrick, also of the firm, litigated to completion an International Trade Commission action in Washington, DC. Resulting in a finding of non-infringement in favor of the firm’s client. Mr. Handal has litigated several intellectual property disputes including:

  • Certain Automated Media Library Devices, U.S. International Trade Commission, Investigation No. 337-TA-746, representing five respondents in a Section 337 investigation involving automated data storage devices.
  • Certain DVD Players and Recorders and Certain Products Containin U.S. International Trade Commission, Investigation No. 337-TA-603, helped obtain favorable settlement for multiple respondents in Section 337 Investigation involving patented DVD player and DVD recorder technology.
  • Overland Storage, Inc. v. BDT Products, Inc., et al., U.S. District Court for the Southern District of California, Case No. 3:10-cv-1700-JLS-BLM, representing defendants in patent infringement litigation related to automated data storage devices.
  • Guardian Media Technologies, Ltd. v. Acer America Corporation, et al., U.S. District Court for the Eastern District of Texas, Case No. 6:10-cv-597-LED, representing three defendants in patent infringement litigation related to parental control technology for DVD players and TVs.
  • Patent Harbor, LLC v. Audiovox Corporation, et al., U.S. District Court for the Eastern District of Texas, Case No. 6:10-cv-361-LED-JDL, representing defendant in patent infringement litigation involving technology for generating and displaying DVD content menus.
  • Collins, et al. v. Western Digital Technologies, Inc., et al., U.S. District Court for the Eastern District of Texas, Case No. 2:09-cv-219-DF, obtained favorable settlement for defendant in patent infringement litigation involving diamond like carbon coating for computer hard disk drives.
  • Multimedia Patent Trust v. Directv, Inc., et al. U.S. District Court for the Southern District of California, Case No. 3:09-cv-278-JAH-CAB, obtained favorable settlement for defendant in patent infringement litigation involving MPEG-2 encoding and decoding technologies.
  • Certain DVD Players and Recorders and Certain Products Containing Same, U.S. International Trade Commission, Investigation No. 337-TA-603, obtained favorable settlement for multiple respondents in Section 337 Investigation involving patented DVD player and DVD recorder technology.
  • Those Characters From Cleveland, Inc. v. The Singing Machine Company, Inc. State of Ohio, Court of Common Pleas, Cuyahoga County, Case No. CV09-692823, obtained favorable settlement for defendant in dispute over copyright/trademark license agreement.
  • Maldonado v. Belt Drives, Ltd., United States District Court for the Southern District of California, Case No. 3:08-cv-1431, obtained favorable settlement for plaintiff in patent infringement litigation related to a patented motorcycle brake design.
  • Technology Licensing Company, Inc. v. jWIN Electronics Corporation, United States District Court for the Northern District of California, Case No. 3:08-cv-3802, obtained favorable settlement for defendant in patent infringement litigation involving a system and method of making and/or viewing DVDs.
  • Technology Licensing Company, Inc. v. Memcorp, Inc., United States District Court, Northern District of California, Case No. 06-cv-7110, obtained favorable settlement for Defendant in patent infringement litigation involving a system and method of making and/or viewing DVDs.
  • Orient Power Hi-Fi Manufacturing Limited v. Peavey Electronics Corporation, Superior Court of California, County of San Diego, Case No. 37-2007-66460, obtained favorable settlement for Hong Kong manufacturer/supplier plaintiff in dispute over approximately $1 million in unpaid invoices.
  • Koninklijke Philips Electronics, et al. v. International Disc Manufacturer, et al., United States District Court for the Southern District of California, Case No. CV06-2468, obtained favorable settlement for defendants in dispute over patent license royalties.

His other case-law experiences includes: intellectual property litigation, Civil RICO, Securities Frauds, Class Actions, Contract Disputes, Business Fraud, Real Estate Disputes, Personal Injury, and Torts. Mr. Handal has settled or tried millions of dollars worth of controversies. His trial verdicts are measured in the millions of dollars. Mr. Handal has several case precedents to his credit including the setting aside of the O'Dench doctrine in California (establishing residual liability of the US Federal Government for the frauds of Directors of companies seized by the government) in the landmark, Ledo Financial vs. FSLIC; and the elimination of judicial enforcement of gaming liabilities in Kelly v. First Astri Corporation. Mr. Handal is a proven litigator having represented clients against major corporate opponents in intellectual property matters including Danaher Corporation (patent infringement, copyright infringement, business fraud) and Massachusetts Mutual life Insurance Company (copyright infringement), Wuxi Multimedia, etc, v. Koninklijke Philips Electronics, N.V., dba Philips Intellectual Property and Standards, Sony Corporation of Japan, Pioneer Corporation of Japan, and LG Electronics (Anti-Trust/Patent Licensing); Jaffe v. Pioneer Company (Consumer Class Action); Koch v. Gateway (Consumer Class Action); and many others.

TRANSACTIONAL: Mr. Handal has constructed and drafted a variety of business documents from boilerplate on invoices to complex purchase and sale agreements. He has consulted clients in major business transactions including the development of strategies to successfully handle them. Mr. Handal has negotiated business transactions exceeding $130,000,000 in value. Recently he acted as lead negotiator on the acquisition of the RCA™ brand from Thomson for an overseas client. CORPORATE: Mr. Handal has been CEO of a start-up technology company, secured patents, directed financial transactions, negotiated contracts, raised capital and handled communications with shareholder/investors. He has successfully negotiated and secured off-shore manufacturing agreements, and acted as General Counsel to a closely held group of companies engaged in the Real Estate, Health Care and Entertainment industries.

PUBLIC COMPANY EXPERIENCE: Most recently, Mr. Handal was appointed to the position of Chief Executive Officer of the Singing Machine Company, a publicly traded (AMEX: SMD) electronics manufacturer and distributor located in Ft. Lauderdale, Florida. Mr. Handal, directed the day-to-day affairs of the company, was responsible for all financial reporting and grew the company into profitability in one year, turning around 4 years of record losses.

REGULATORY: Mr. Handal is one of a handful of attorneys in the State of California that regularly represents Knox-Keene licensed health plans before the California Department of Managed Health Care.
