So BLR it is all in a relative perspective. Lets do the math...

To calculate the benefit of an appeal, lets take the odds of an overturn of the rejection at .15 and divide by the odds of an overturn without an appeal, which is .00 while using a modulo of 1, we get a result that the outcome of an appeal is 100% better than the outcome without an appeal.

Dischino's theory that the appeal was filed "Just in Case" is a possibility also, and may make the odds mute.

Smans data showing that the appeal might put pressure on the examiner to accept a better compromise also seems a possibility.

As a caveat, none of my patents have ever gone through a re-exam, so this is all new territory for me. Doni , emit , and sman seem to have more experience in these matters.
