It appears that E-Digital was not able to convince the Examiner that the original claim 5 was not covered by prior-art.

So E-Digital went ahead and ammended the claim. The examiner called the patent attys to discuss it.

The other option was to appeal to a different Examiner, but that would have been time consuming. So E-Digital probably did the smart thing.
