From April 4 , press release : "e.DIGITAL will request amendment of its patent US 5,491,774 in response to a rejection of certain claims from the United States Patent and Trademark Office (USPTO) which was recently received. As is customary, e.Digital expects to incorporate modifications to certain rejected claims while leaving a majority of US 5,491,774 claims unchanged. The Company expects, but cannot assure, that the planned modifications will overcome the rejection and further believes the modifications could clarify and strengthen its ability to enforce future infringement of US 5,491,774.

The specification shows that although the control circuitry itself does not generate electrical power , it can supply electrical power from the power source to the device.

The specification explains that , the control circuitry 21 and associated functional components are powered by a battery source 40 which is described in greater detail hereafter. Control circuitry is provided to enhance power conservation and to more efficiently control allocation of voltage level to circuitry components in accordance with specific power needs . The control circuitry includes embedded software commands for disabling certain circuitry components when not needed , as well as trigger commands to restore power for rapid response of disabled circuits. An alternate AC /DC input port is also provided.

“ 774 patent at 5 : 22 – 32

Note that the patent owner does not impermissibly seek to import these examples as limitations into the claims -these examples only illustrate why the arrangement of “ power supply”----->” control circuitry” ------> “ device “ is important.

AS EXPLAINED IN THE PREVIOUSLY SUBMITTED RESPONSE , THE PRIOR ART DOES NOT DISCLOSE A “ POWER SUPPLY COUPLED TO THE CONTRO CIRCUITRY FOR SUPPLYING POWER TO THE DEVICE “ AS RECITED BY claim 1.

From second e.DIGITAL supplemental response to USPTO Re-examination.
