I have noted in the past that eventually considerations of the original patent, such as the "control circuitry" issue of the current re-exam, will not maintain as stated above. However, many patents can be built on that one issue....such as 445......IMO, 445 is the root patent of the new patent cluster. It all ties back to the original patent and the "control circuitry"....and do not, IMO, have to be directly in the original patent family.
This is why the re-exam is important to be positive.
445 references 774 as a typical type usage for 445.
The "control circuitry 21" of 774 is important to 445 and 445 is important to 774 as on operating system.....where they are not of the same family.
If 774 re-exam is not positive....I guess the "control circuity" conditions become a public issue a few years early. 445 will still hold its patent and methods over the current argued issues if the 774 considerations are made a public issue.
I would really like to see them hold the patent for the life that still remains.....and follow through with the leverage it provides them in getting full access to initial market positions.
I would like that they get full notoriety of inventing and bringing the root details to the market.
It will not be over for e.Digital with a dis-positive response.....however, it will be disappointing....as a leveraged stepping stone. They will still own the caching considerations of 445 which are very important to have if 774 is dis positive.
