JMVHO--you say "If, in the long run it doesn't help...."--I think what Doni is trying to say is that in his opinion that we all are focusing on the short run, the here and now(understandably) and he thinks that in the long run ie. reexam, DM will eventually get us to a better place based on how the ruling went. And maybe it would be better to say that DM got some of what they wanted and the defendants got nothing of what they wanted. In his mind it was a net gain for Edig, however the investors waiting for the big pop on total good news out of the Markman hearing did not see it that way and all bailed.
