NOTICE REGARDING PENDING SETTLEMENT AND
STIPULATION FOR EXTENSION OF TIME

In September 2011, plaintiff e.Digital Corporation (“e.Digital”) and defendants DXG
Technology (U.S.A.), Inc. and DXG Technology Corporation (collectively “DXG”) reached an
agreement in principle to settle their respective disputes. e.Digital and DXG need additional
time to finalize and execute their agreement, meet any obligations under the agreement, and
submit a motion for dismissal. Therefore, e.Digital and DXG agree (1) to suspend all
outstanding discovery requests, responses, and exchanges and (2) to extend all of the due dates
these parties have with regard to deadlines to provide information to each other from when they
reached settlement in principle to the time the Court orders the dismissal. These parties further
agree that such extension does not prejudice any of these parties.
