not to be argumentative but, I do not recall that DM told any member of this board that "there was always a problem with the patents"--it would seem to me that an attorney involved in the case would not say something like that to someone in the hearing audience. If the person that heard it or if someone else knows it happened, please correct me. Also, has DM stated that they would definitely wait for the re exam before proceeding? I thought that was still in doubt.
