I can't see them standing still when they do not have to do so.
It would be most interesting to see how a new proposal would be approached to get over the ambiguities of the 774 patent....and tie it to 737 more clearly....
FWIW...
IMVHO....the key to presenting a new claims construction approach is in the balance of the published phrase for both the "recording medium" of claim 19, and the "flash memory" of claim 1 and 19....that the current court did not weigh in on.
"recording medium" which is capable of retaining recorded digital information for storage;
"Flash memory"... "and is capable of retaining recorded digital information for storage in nonvolatile form;"
The court did not approach that issue....that is a consideration of both memory types....analog memory and digital memory.
digital information ....is not digital data....and some how they have to get 737 tied to that issue more clearly.
