has been pending for reconsideration for almost a year too. IMO lowly and plankton...our position seems really simple...the examiner thought our application was based on a 2006 file date, when it was actually carved out of a 2004 prior filing....(child)...IMO the position seems quite clear...it appears that the "prior art" imo, all happened allegedly between 2004 and 2006 and might be cleared up easily
