I believe DM calcs in sales projections for the future as part of the negotiations. Market share, number of units sold in the past, growth rate...guessing on both sides, until the exprirations of the patents, meaning the license of the Flash-R includes an assumed value the party makes from future sales and wraps everything into a one time fee.

This was an opinion from a few here in the past along with some comments at the last 2 SHM's.
