While the partial ruling, which still remains unclear, narrows the scope of EDIG's claims, the defendants still remain at risk.
If they think they can settle for $1 million versus another year or two in court while facing the risk of the ruling being reversed by a higher court, they all may choose to settle and move on and eliminate that unknown risk.
A ruling reversal could double, triple or quadruple their risk exposure, if not more, should this go before a jury.
Will DM force the issue to a higher court with some of the remaining infringers or will they look to settle the remaining 10 ?
What would another 8-10 settlements do for EDIG's bottom line this fiscal year?
IF DM can create an environment that allows EDIG to continue to file infringement suits, this stock should not only recover what it lost on "Markman Day", but move up from there.
