My understanding is that he was looking to get Nunchi onboard with one or two new partnerships by now. I am hearing that time frame may have been too ambitious, but regardless, Nunchi is his baby, at least, that is my take.

I don't think his plan is to wait until the patent process is complete, but rather, he was looking for immediate revenue results.

That is the most pressing issue for me, as that gives this company its new direction while this FlashR patent mess wades through the court system.
